1. Rights of environmental inspectors
When conducting on-site inspections, there shall be no less than two environmental supervision personnel engaged in on-site law enforcement work, and they shall present administrative law enforcement documents such as the "China Environmental Supervision and Law Enforcement Certificate" to indicate their identity and explain the law enforcement matters.
Environmental monitoring personnel have the following rights:
(1) Enter relevant places for survey, sampling, monitoring, photography, recording, video recording, and making records;
(2) Search and copy relevant materials;
(3) Meet and inquire with relevant personnel, request clarification on relevant matters, and provide relevant materials;
(4) Order to cease or rectify illegal activities;
(5) Apply the simplified administrative penalty procedure and make an administrative penalty decision on the spot;
(6) Other measures stipulated by laws, regulations, and rules.
Enterprises must remember not to violently resist the law, fail to execute or cooperate with the work of supervisory personnel. Otherwise, the consequences will be serious
2. The contents that are usually inspected during environmental monitoring
(1) Production situation of the enterprise
a、 Industry and main products of the enterprise.
b、 Last month's products and production capacity, and whether there are any operations in each line.
(2) Implementation status of enterprise environmental protection
a、 Whether the project has fulfilled the environmental impact assessment procedures in accordance with the law, reviewed the environmental impact assessment documents and approvals, etc;
b、 Check the nature, production scale, location, production process or pollution used in the project
c、 Are the governance measures consistent with the environmental impact assessment and approval documents. If the project only starts construction five years after the environmental impact assessment approval, is it necessary to reapply for environmental impact assessment.
d、 Check whether environmental completion acceptance has been carried out after the project is put into operation. Whether the environmental protection completion acceptance procedures are complete.
e、 Production workshop: Are the floors of workshops with excessive or raw materials that are prone to acid, alkali, and other corrosive substances treated with anti-corrosion measures and regularly maintained. Is there any leakage during the production process on site.
f、 Check the application for pollutant discharge permit, implementation of pollutant discharge declaration, and implementation of pollutant discharge fee payment
On site inspection of various pollution and control situations: Enterprises without relevant pollution discharge links (such as the impact on groundwater) may not be inspected
3. Environmental supervision and law enforcement mainly inspect eight aspects at the enterprise site
(1) Environmental monitoring of water pollution sources
The operational status, historical operation, treatment capacity and water volume of sewage treatment facilities, quality management of wastewater, treatment effectiveness, sludge treatment, and disposal. Have you established an operational ledger for wastewater treatment facilities (including key operating times, daily inflow and outflow of wastewater, water quality, dosing, and maintenance records)
(2) Supervision of sewage discharge outlets
Check whether the location of the sewage discharge outlet complies with regulations, whether the number of sewage discharge outlets of the sewage discharger complies with relevant regulations, whether monitoring sampling points are set up in accordance with relevant pollutant discharge standards and regulations, and whether standardized flow measurement sections for measuring flow rate and velocity are set up. The main sewage outlet must be equipped with environmental protection signs, etc. Have online monitoring and monitoring devices been set up as required.
(3) Drainage volume review
a、 If there are flow meters and pollution source monitoring equipment, check the operation records;
b、 For those with water supply devices or water consumption vouchers, the drainage volume shall be calculated based on the water consumption;
c、 For those without measurement data and valid water consumption vouchers, estimate the number of water and drainage systems for similar enterprises according to relevant national standards and manuals.
(4) Discharge water quality
a、 Check whether the quality of discharged wastewater meets the requirements of national or local pollutant discharge standards;
b、 Check the models and specifications of monitoring instruments, meters, and equipment, as well as their calibration and verification status;
c、 Check the monitoring analysis methods and water quality monitoring records used. If necessary, on-site monitoring or sampling can be conducted;
d、 Check the situation of rain and sewage separation, and verify whether the polluting units have implemented clean and sewage separation, as well as rain and sewage separation.
(5) Emergency disposal facilities for accident wastewater
a、 Check whether the emergency disposal facilities for accident wastewater of polluting enterprises are complete, and whether they can ensure the interception, storage, and treatment of wastewater generated in the event of environmental pollution accidents.
b、 Check the reuse of treated wastewater
(6) Exhaust gas pollution inspection
Check the operational status, historical operation, treatment capacity, and processing capacity of the exhaust gas treatment facilities.
Inspection of exhaust gases generated by combustion in boilers, petrochemicals, chemical industries, etc.:
a、 Check whether the continuous generation of combustible organic waste gas by chemical, petrochemical and other enterprises is treated reasonably by adopting recycling or incineration methods, and whether the intermittent generation of combustible organic waste gas is treated reasonably by incineration, adsorption or combined processes.
b、 Check the verification procedures and performance indicators of boiler combustion equipment, inspect the operation status of combustion equipment, check the control of sulfur dioxide, and check the control of nitrogen oxides.
Process waste gas, dust, and odor pollution sources:
a、 Check whether the emissions of exhaust gas, dust, and odors meet the requirements of relevant pollutant emission standards;
b、 Check the recycling and utilization of flammable gases;
c、 Check the environmental protection measures for transportation, loading and unloading, and storage that can emit toxic and harmful gases and dust;
Air pollution prevention and control facilities:
Dust removal, desulfurization, desulfurization, and other gaseous pollutant purification systems
Exhaust emission outlet:
a、 Check whether the polluters have built new exhaust pipes in areas where the installation of new exhaust pipes is prohibited;
b、 Check whether the height of the exhaust pipe complies with the national or local pollutant emission standards;
c、 Check if sampling holes and monitoring platforms are installed on the exhaust pipe of the waste gas;
d、 Check whether the exhaust port is set up according to the required specifications (height, sampling port, signboard, etc.), and whether the required exhaust gas is installed and practical online monitoring facilities are installed according to the environmental protection department.
Unorganized emission sources:
a、 For emission points that discharge toxic and harmful gases, dust, and smoke without organization, if conditions permit organized emissions, check whether the polluting units have carried out rectification and implemented organized emissions;
b、 Check the dust generated in coal yards, material yards, and goods, as well as the dust generated during the construction process, and whether measures have been taken to prevent dust pollution or dust prevention equipment has been installed as required;
c、 Monitor at the boundary of the enterprise to check whether unorganized emissions meet the requirements of relevant environmental standards.
(7) On site inspection of solid waste pollution sources
Inspecting the sources of solid waste:
a、 Check the types, quantities, physical and chemical properties, and generation methods of solid waste.
b、 According to the new National Hazardous Waste List or GB5085, inspect the types and quantities of hazardous waste in production
Solid waste storage and disposal:
a、 Check whether the polluters are located in natural reserves, scenic spots, drinking water source protection areas, basic farmland protection areas, and other areas that require special protection, assuming that industrial solid waste is centrally stored and disposed of in facilities, places, and domestic waste landfills
b、 Check if solid waste storage facilities or sites are equipped with facilities that meet environmental protection requirements
For temporary solid waste storage and stacking sites:
a、 For the storage, treatment, and disposal of hazardous waste;
b、 Check whether the polluter dumps solid waste to rivers, lakes, canals, canals, reservoirs, beaches and bank slopes below the highest water level and other places where dumping is prohibited by laws and regulations.
(8) Solid waste transfer
a、 Check the transfer of solid waste
b、 Check whether the hazardous waste transfer manifest is filled out for the transfer of hazardous waste. And with approval from the city level or above where the relocation is located.
